This is the last Will and Testament of me Robert Marshall of Eden Bridge in the
county of Kent gentleman. First I do hereby order and direct all my just debts and
funeral and testamentary expenses to be fully paid and discharged.
I do hereby give and bequeath to my three daughters Anne Pontifex, Sarah Pontifex
and Mary Pontifex all monies which may be payable to my executors in respect of a
policy of insurance that has been effected on my life in the Norwich Union Insurance
Company and in case any or other of my daughters shall die previous to my decease,
then I direct that the share of such as may so die shall go and be divided equally
amongst the child or children of such as may so die such child or children to take the
same share as his her or their mother would have been entitled to if she had lived.
I give devise and bequeath all my real estate of whatever kind or nature soever and
also all and every the rest residue and remainder of my personal estate of all kinds and
descriptions to my son Henry Marshall of Godalming Surrey and John Pontifex of St.
Andrew's Court Holborn upon trust that they the said Henry Marshall and John
Pontifex so immediately make sale and dispose of the same for the best prices they
may be able to procure and stand possessed of the produce thereof upon further trust
to divide the same equally between all and 'every of my sons and daughters who shall
be living at the time of my decease and the child or children of such of my said sons
and daughters who shall have died the child or children of those who may have died
to take only the share that his or her or their parent would have been entitled to.
I hereby request that my trustees be paid all the expenses of carrying this my Will into
execution and do give them every power as far I can which may enable them to do so
and I do further appoint them the executors thereof and I do hereby revoke and make
void all former and other wills by me at any time hereto for made and do declare these
presents only to be and contain my last Will and Testament.
In witness whereof I the said Robert Marshall the testator have hereunto to this Will
contained in one sheet of paper set my hand and seal this fifteenth day of March
eighteen thirty -Robert Marshall -signed sealed published and declared by the said
Robert Marshall the testaor as and for his last Will and Testament in the presence of
us who at his request in his presence and in the presence of each other have hereunto
subscribed our names as witnesses thereto -John Feelleck William Clifford clerks to
Mr. Pontifex St. Andrew's Court Holborn Solr.
I Robert Marshall of Eden Bridge in the county of Kent gentleman do hereby declare
the following to be a codicil to my last Will and Testament which bears date and was
signed sealed published and declared by me as such on the fifteenth day of March in
the year of our Lord one thousand eight hundred and thirty first
I do hereby give and devise to my son Henry Marshall of Godalming in the county of
Surry Solr and to his heirs and assigns for ever all that my messuage tenement and
premises with the appurtenances thereunto belonging situate and being at Godalming
aforesaid in the county of Surrey and called The Mead Row House being opposite The
Three Lions.
Next I give and bequeath to my daughter Mary the wife of John Pontifex all my goods
furniture linen china and other things belonging to me and being at or appurtenant to
any house in Eden Bridge aforesaid except plate which I desire may be divided by my
said daughter Mary at here discretion equally as near as maybe amongst her own
children and the children of my son in law Edmund Pontifex and of my son in law
William Pontifex.
Next I direct that my executors should pay a year's rent for my said house at Eden
Bridge, after my deceased. I also request and desire that my executors shall bury me
at Eden Bridge aforesaid in a similar manner to the burial of my poor John Alexander
and that the funeral be conducted by Mr. Chandler.
I give and bequeath to the poor of the parish of Eden Bridge ten pounds to be
distributed amongst them by the churchwardens as they may see fit in bread. I also
give and bequeath to my trustees and executors the sum of £50 each. In all other
respects I do hereby ratify and confirm my said last Will and Testament.
In witness whereof I have hereunto set my hand and seal this eighth day of November
one thousand eight hundred and thirty eight in the presence of the witnesses hereunder
subscribed -Robert Marshall -signed sealed published and declared as a codicil to his
last Will and Testament by the said Robert Marshall in the presence of us who at his
request and in the presence of each other have subscribed our names as witnesses
hereto -Henry Pain Eden Bridge -Harriot Mills Eden Bridge.
In the Prerogative Court of Canterbury in the goods of Robert Marshall Esquire
deceased appeared personally John Pontifex of St. Andrew's Court Holborn in the city
of London Esquire and made oath that he is one of the executors named in the last
Will and Testament with one codicil thereto of Robert Marshall late of Eden Bridge in
the county of Kent Esquire deceased The said codicil being now hereunto annexed
and bearing date the eighth day of November one thousand eight hundred and thirty
eight and having now kept carefully inspected the said codicil he the appearer saith
that the said deceased duly executed the said codicil on the day on which the same
bearer's date as aforesaid by signing his name at the end thereof in the presence of
him the appearer as also of Henry Pain and Harriet Mills the subscribed witnesses
thereto all of whom were present at the same time and that both the said subscribed
witnesses thereupon ascribed and attested the execution of the said codicil in the
presence of each other of him the appearer and of the said deceased -John Pontifex -
on the 7th day of March 1842 the said John Pontifex was duly sworn to truth hereof
before me F.T. Pratt Surr. - W Rothery.
Proved at London with a codicil the 27th of March 1842 before a judge by the aids of
Henry Marshall~ the son and John Pontifex Esq the executors to whom admon was
granted having being first sworn to wit. the said Henry Marshall before the worshipful
Jesse Addams and the said John Pontifex before the worshipful William Calverley
Curteis respectively Doctors of Laws and surrogates duly to administor.
